A Power of Sale is a legal process that allows a lender to sell a property when a homeowner has defaulted on the terms of their mortgage. Unlike a traditional home sale, where the homeowner decides when and how to sell their property, a Power of Sale is initiated by the lender to recover the outstanding mortgage debt.
One of the biggest misconceptions about Power of Sale properties is that banks simply "sell them cheap." In Ontario, lenders have a legal obligation to make reasonable efforts to obtain fair market value for the property. The objective is to recover the outstanding mortgage balance while ensuring the property is marketed and sold at a price that reflects current market conditions. As a result, many Power of Sale properties are listed on the MLS® and sold through the same process as any other home.
While Power of Sale properties can present excellent opportunities for homebuyers and investors, they also require careful due diligence. Many are sold "as is, where is," meaning the lender may not complete repairs or provide the same warranties or property disclosures that are often available in a traditional homeowner sale. Buyers should be prepared to inspect the property where permitted, review its condition carefully, and obtain appropriate legal and financial advice before proceeding.
Every Power of Sale property is different. Some are move-in ready, while others may require repairs or renovations. Although these properties can offer good value, purchasing a Power of Sale does not automatically mean buying below market value. The best opportunities come from understanding the local market, comparing recent sales, evaluating the property's condition, and recognizing when a property is priced competitively.
